Terms & Conditions for Online Purchase of Alcoholic Beverages

1. Introduction

1.1 These Terms & Conditions (“Terms”) govern your use of the website (and any associated apps) of CRUSHABLE (“we”, “us”, “our”) for the purchase of alcoholic beverages (the “Products”) online.
1.2 By placing an order with us you confirm you have read, understood and agree to these Terms, and that you will comply with them.
1.3 We reserve the right to amend these Terms at any time. The version published on our website at the time of your purchase applies.

2. Eligibility / Age Verification

2.1 You must be of legal drinking age in your province/territory of delivery (in Ontario, 19 years). AGCO
2.2 By placing an order you represent and warrant that you are of legal drinking age, and that the recipient of delivery (if different) is also of legal drinking age.
2.3 We will implement age-verification procedures (including asking for government-issued photo ID at delivery or pickup). We reserve the right to refuse delivery if the recipient’s age cannot be verified or if the recipient appears intoxicated. Government of Ontario
2.4 You must not provide or facilitate the supply of any Product to a person under the legal drinking age. Violation may result in cancellation of your account and referral to authorities.

3. Ordering, Payment and Card-Network Compliance

4.1 All orders are subject to acceptance by us. We may refuse or cancel any order for any reason, including inability to verify age, shipping address outside licence area, suspected fraud, or non-compliance with card-network rules.
4.2 Payment must be made in full at the time of order via the methods specified on our website. Card payments are processed in accordance with the rules of the relevant card-network (e.g., Visa). 4.3 You represent and warrant that the payment method used is your own and is not fraudulent or otherwise in breach of applicable law or card-network rules (e.g., the Visa Core Rules). Visa+1
4.4 If our acquirer or card-network prohibits delivery of alcohol in a jurisdiction or to a particular address, we may cancel or refuse such order and refund payment.
4.5 You agree that the Products are for personal consumption only and not for resale unless you hold the required licence.

4. Delivery & Pickup

5.2 The person accepting delivery must be of legal drinking age, must present valid government-issued photo ID verifying date of birth, and must sign for receipt. If we (or our delivery agent) cannot verify age or identity, we may refuse delivery and cancel order (refund will apply as per our refund policy).
5.3 The Products must not be delivered to intoxicated persons or to places where delivery of liquor is prohibited under applicable law. Government of Ontario
5.4 For curb-side pickup orders (if applicable) you must bring and display valid government-issued photo ID proving legal drinking age at pickup, and you must pick up during the specified pickup window.
5.5 Once delivery is completed or pickup occurs, risk passes to you. We are not liable for unauthorised transfer of the Product to a minor or third party.

6. Returns, Refunds & Cancellations

6.1 Because of the nature of alcoholic beverages and applicable hygiene/liquor-licensing rules, orders may not be cancelled or returned once processed, except as required by law (e.g., defective product).
6.2 If we cancel an order due to non-compliance (e.g., failed age verification, delivery address outside licence area, payment issues) we will refund the payment in full as soon as reasonably possible.
6.3 If you refuse the delivery, fail to take delivery (and we incur costs), or otherwise violate these Terms, we may withhold refund or deduct costs incurred.
6.4 Any refund will be credited back to the same payment method unless otherwise agreed.

7. Advertising, Promotions & Loyalty Programs

7.1 All advertising, pricing, promotions and loyalty/points programmes shall comply with applicable liquor-licensing regulations (e.g., in Ontario you may not offer free or discounted merchandise contingent upon purchase of liquor). Government of Ontario+1
7.2 We reserve the right to terminate or vary any promotional offer at any time without prior notice if required to comply with law or regulatory condition.

8. Limitation of Liability & Indemnification

8.1 To the maximum extent permitted by law, our liability for any loss, damage or injury arising from your use of the website or purchase of Products is limited to the purchase price of the Products.
8.2 You agree to indemnify and hold us harmless from any claims, damages, fines or losses arising from your breach of these Terms, your violation of applicable age-restriction laws or card-network rules, or your resale of Products in breach of licence.
8.3 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded under applicable law.

9. Governing Law & Jurisdiction

9.1 These Terms shall be governed by and construed in accordance with the laws of the Province of [Insert Province] and the federal laws of Canada applicable therein.

10. Miscellaneous
